Appeal against Pentara Project Dismissed

The Civil Appellate High Court of the Western Province has dismissed all applications seeking to halt construction of Home Lands Group’s Pentara Residences in Thummulla, Colombo, refusing leave to appeal and interim relief sought by nearby residents.

In an order dated 11 December 2025, the Court upheld the Colombo District Court’s decision not to grant urgent enjoining orders, ruling that construction had already been underway for several months and that the required urgency was not established. The Court also observed that the action appeared aimed at avoiding the equitable principle that delay defeats equity.

Residents had complained of noise, vibration and dust from construction activities. However, the Court noted that multiple state agencies, including the NBRO and CEA, had already examined these concerns.

Pentara Residences is a BOI-approved US$100–110 million twin-tower luxury housing project, fully cleared by statutory authorities and currently under construction.
